Pre Hearing Facilitation and Hearing Process

As at 18 June 2008

New item! icon.  Revised Hearings Timetable and Variation Process Letter

Environment Canterbury is revising the timeframe for the hearing of submissions on Proposed Change No. 1. The reason for the delay is:

  • to allow for an application for judicial review in the High Court by National Investment Trust on the composition of the Hearing Panel to be determined, and;
  • to allow for a variation, as described in the PDF download icon. letter to submitters file size icon.  29kB, to be notified.

The hearings scheduled to commence on the 4th July are deferred and will not take place until early 2009. Consequently, the dates for the provision of evidence and legal submissions are no longer required to be met.

Except for new dates the procedural arrangements for the hearings remain unaltered.

1. Pre Hearing Facilitation Dates

All  Pre Hearing meetings will take place from 9.00am-12.30pm at Environment Canterbury, 58 Kilmore Street, Christchurch.

2. Hearing Process Key Dates

Friday 23 May   Officers Reports on Submissions Available
Hard copy posted, disks available at Customer Services and copy on Environment Canterbury website.

Monday 23 June  Hearing Panel requests all evidence, including expert evidence, to be called by any submitter be provided in writing (email copy preferred) to Environment Canterbury no later than 5.00pm 23 June.

Note : It will take some days to allow the evidence to be loaded onto Environment Canterbury’s website and made available on disk to all parties.

Thursday 26 June  Hearing Panel direction that any expert evidence to be called by any submitter be provided in writing to the Council no later than 26 June 2008.

Monday 30 June  Hearing Panel requests that any legal submissions on behalf of any submitter be provided in writing (email copy preferred) to the Council.

Friday 4 July  Hearing commences

July/ August  Hearing of submissions.

Friday 28 November  Decisions on submissions available
