The Canterbury Regional Council has made a submission on the application by Te Rūnanga o Ngāi Tahu and the Department of Conservation to amend the National Water Conservation (Lake Ellesmere) Order 1990, and has prepared evidence in support of its submission. The Council is neutral, neither supporting nor opposing the application, because the Council has to hear the application and submissions, and make recommendations to the Minister for the Environment on the application under the Environment Canterbury (Temporary Commissioners and Improved Water Management) Act 2010. However, the Council still needs to make a submission and be part of proceedings because water conservation orders (WCOs) affect the Regional Policy Statement, regional plans and the issuing of resource consents. In addition, in this catchment the Regional Council is the agency who manages the artificial opening of Te Waihora/Lake Ellesmere under the Soil Conservation and Rivers Control Act 1941 and other legislation. The WCO affects when and how the lake can be opened.
