The period for lodging appeals with the Environment Court closed in November 2007. There were originally 25 appeals covering Chapters 1, 2 and 3. These are now being addressed through the Environment Court.
Those parts of Chapters 1-3 which are not subject to appeal are ‘beyond challenge’ and can be regarded as being operative.
As the appeals are processed, and issues resolved, parts of Chapters 1-3 will move ‘beyond challenge’ before others. The version of Chapters 1-3 and the rules table below, show those provisions that are beyond challenge, and those that are still subject to appeal. Provisions subject to appeal are highlighted in yellow. This version of the plan will be updated regularly, as each of the appeal topics is resolved beyond legal challenge.
